Let's talk about what happened, who's to blame, what you need, and how to proceed.
A successful claim begins with a plan. We'll outline your goals and what you can expect, then personalize a plan of attack.
This is where we get into the thick of it. We prepare legal documents and file forms with insurance companies. We build up our evidence and establish why the defense is responsible for the injury.
This is just what it says. At this point, the other side either settles for a fair amount or we go to trial and get you the amount you deserve.

The insurance companies don’t want you to know

Generally, an injured person has a claim for damages if another person or entity was negligent and that negligence caused their injuries. However, assessing negligence and causation can be complicated. In some cases, there is more than one responsible party, and it's important to identify them all. You may still be able to recover damages even if you are partially responsible for the accident that caused your injuries.
The best way to determine whether you have a valid personal injury claim and who may be liable for your losses is to talk to a personal injury attorney in North Charleston as soon as possible after your injury.
Most personal injury law firms, including The Hartman Law Firm, work on a contingency basis. That means you don't pay legal fees unless and until your lawyer settles your case or secures a verdict in your favor. Then, attorney fees and any costs you are responsible for will be deducted from your settlement or award.
When you consult a personal injury lawyer in North Charleston, they will explain in more detail how percentage-based fees work and any other expenses you will be responsible for. This will also be spelled out in detail in your written contingency fee agreement.
A personal injury lawsuit starts with a complaint filed in the Court of Common Pleas, a division of the Circuit Court. The complaint must include very specific information to establish jurisdiction, venue, timeliness, and the basis for the claim. Your injury lawyer can ensure that all procedural and substantive requirements are fulfilled.
However, you should know that many personal injury claims are settled without filing a lawsuit. Your attorney may be able to negotiate a settlement for you without going to court.
The time to resolve a personal injury case can vary significantly. A straightforward claim, especially one with a relatively small amount of money involved, may settle in just a few months, occasionally even faster. Complicated cases involving long-term injuries and extensive damages may take two years or more. And some cases never settle and have to go to trial.
Your personal injury lawyer can give you a better idea of the likely timeline in your case based on past experience with cases similar to yours.
Damages in personal injury cases generally fall into one of two categories: economic and non-economic damages. Economic damages are actually financial losses due to your injury, such as medical bills, lost wages, the need for medical equipment, or to remodel your home to make it accessible, household assistance required due to your injuries, and similar expenses.
Non-economic damages include intangible losses such as loss of quality of life and pain and suffering.
In some cases, you may also be entitled to punitive damages.
There are several elements involved in maximizing compensation for a North Charleston personal injury claim. First, you'll want to find the right personal injury lawyer for you as soon as possible after your injury, so the attorney has the best opportunity to gather evidence while it's fresh.
It's also important that you follow your attorney's advice and the advice of your medical professionals. Missteps could diminish the value of your claim. For example, if you fail to follow through with medical care, the insurance company will likely argue that you're partly responsible for your own damages.
The very first thing you should do is check yourself for injuries and seek whatever medical attention is required. If you aren't sure, err on the side of caution and see a doctor.
If you're able, you should take photographs at the scene and collect contact information from any witnesses. Then, you should contact a personal injury lawyer in North Charleston as soon as you are able. Common mistakes people make in the hours and days following an accident can hurt your case and cost you money. It is generally best to let your personal injury attorney communicate with the insurance company on your behalf.

The Hartman Law Firm handles all personal injury cases on a contingency fee basis. That means your fees are based on a percentage of your settlement or award. That percentage is agreed on in advance. If you don't receive compensation, you pay nothing: no legal fees and no costs of litigation.
